Lawyerspeak gold. A Political Glimpse From Ireland points to a highly entertaining and enlightening seven-page piece of correspondence from counselor to counselor. The subject is a potential defamation suit coming from Twitter-tweets tweeted by an unhappy customer. See Section III of the letter first, for the salient facts. Political Glimpse explains:
The letter, which deserves to be read in full, concludes with the declaration that the customer intends to pursue counteraction according to the principle of muram aries attigit, which translates as “the ram has touched the wall.”
This refers to a Roman military policy toward cities the Romans placed under siege. The local authority would be told that, as a matter of policy, once the first battering ram touched the city wall, there would be no surrender accepted, no quarter and no mercy.

1. After being mistreated by the Hyundai dealership, why on God’s green earth did Alascio return there for service on his vehicle instead of going somewhere else?
2. Why didn’t Alascio simply complain to the dealership’s manager about this employee, instead of Twittering about it? Why not actually, you know, DO SOMETHING about the problem instead of griping on the Internet? I’m assuming the one who refused to service his car is the same one who called him at home trying to get money out of him, and who flew off the handle when the defendant tried to make a deal with him. I’d make sure that guy got fired.
3. Why did Alascio agree to pay any amount of money at all for the original damage claim, instead of sticking to his guns? His wife told the dealership that the loaner car wasn’t appropriate for the kind of driving it would be doing? When presented with the demand of money, I would have said, “Uh….NO. You were warned.” I also would have informed my insurance company that I was refusing to cooperate, and not to pay the dealership anything.
Am I missing something here? As amusing as all this is, the defendant is still out some amount of money for what his insurance company paid out (they’ll probably try to raise his rates), as well as whatever he paid this attorney to get involved and “smackdown” the plaintiff’s claim.
There’s also an object lesson here – do not mouth off on the Internet. It’s frightening, really. The next guy who does it may not be so lucky as to have a legally unassailable position.
