Volokh posted on this back on 11/24. I always read those guys on any legal question that hits the news… they’re the preeminent law blog, IMHO. The comments on the thread I linked are interesting, as is the follow-on post. Assuming you like “down in the (legal) weeds” discussions of precedent and all that.
I think Hillary will be “Saxbe-ed” and that will be the end of it, although a legal challenge wouldn’t surprise me. Nothing much surprises me these days, come to think on it.
- Buck | 12/04/2008 @ 16:53I was going to blog about this yesterday, with something along the lines of “This is going to be an early indication of how Obama is going to interpret the document he’s about to swear to protect and defend.” Then, I read about the Saxbe fixes, and it’s really a moot point. Democrats have done it, Republicans have done it, and I believe that it’s in the spirit of the law. Besides, Hillary isn’t taking Secretary of State for the money… 🙂
